By downloading, installing, or using the Minj application ("App"), you agree to be bound by these terms and conditions ("Agreement"). If you do not agree to all terms of this Agreement, you must not use the App. This Agreement constitutes a legal agreement between you and the developers of Minj ("we", "our", or "us").
We reserve the right to modify this Agreement at any time. When we do, we will revise the "last updated" date at the bottom of this Agreement. Your continued use of the App after any such changes constitutes your acceptance of the new terms.
We grant you a limited, non-exclusive, non-transferable, revocable license to use the App for your personal, non-commercial purposes, subject to this Agreement. This license does not include any right to: (a) use the App for commercial purposes; (b) modify, adapt, or create derivative works of the App; (c) distribute, transfer, sublicense, lease, lend, or rent the App to any third party; (d) reverse engineer, decompile, disassemble, or attempt to derive the source code of the App; or (e) use any automated means to access the App.
The App provides features including but not limited to photo framing, decorative stickers, overlays, gallery management, and high-definition export capabilities. All features are provided "as is" and we reserve the right to modify, add, or remove features at any time without prior notice.
You acknowledge that certain features may be subject to availability and may require coins. The initial 100 free coins provided are for promotional purposes and have no monetary value. Coins cannot be exchanged for cash or other monetary instruments.
All frames, stickers, overlays, and other visual elements provided within the App ("App Content") are the property of Minj or its licensors. You may use App Content solely within the App for creating your personalized photos, but you do not acquire any ownership rights to App Content.
You retain all ownership rights to photos, images, and other content you upload or create using the App ("User Content"). By using the App, you grant us a non-exclusive, worldwide, royalty-free license to use, reproduce, modify, adapt, publish, translate, distribute, and display your User Content solely for the purpose of providing and improving the App's functionality, including but not limited to processing your photos, storing them in your gallery, and enabling you to export them.
You represent and warrant that: (a) you own or have the necessary rights to all User Content; (b) your User Content does not violate any laws, regulations, or third-party rights; and (c) your User Content is not harmful, offensive, or inappropriate.
We reserve the right to remove any User Content that we reasonably believe violates this Agreement, but we have no obligation to monitor User Content.
The App may be used without creating an account. However, if you choose to provide any information to us, you agree to provide accurate, current, and complete information and to update such information as necessary.
You agree not to: (a) use the App for any illegal or unauthorized purpose; (b) violate any applicable laws or regulations; (c) interfere with or disrupt the App or servers or networks connected to the App; (d) attempt to gain unauthorized access to any portion of the App or any other user's data; (e) upload or transmit viruses or other harmful code; (f) use the App to create or distribute inappropriate, offensive, or infringing content; or (g) engage in any other conduct that could harm us, other users, or third parties.
We may terminate this Agreement and your access to the App at any time, with or without cause, by providing you with notice. Upon termination, your license to use the App will immediately cease, and you must stop using the App.
You may terminate this Agreement at any time by uninstalling the App from your devices.
Sections 4, 8, 9, 10, and 11 will survive termination of this Agreement.
THE APP IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.
THE RESULTS OBTAINED FROM USE OF THE APP MAY VARY DEPENDING ON FACTORS INCLUDING PHOTO QUALITY, DEVICE CAPABILITIES, AND USER INPUT. WE DO NOT GUARANTEE THAT ANY SPECIFIC RESULTS WILL BE ACHIEVED THROUGH USE OF THE APP.
IN NO EVENT SHALL WE BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR OTHER INTANGIBLES, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OR INABILITY TO USE THE APP, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THIS AGREEMENT OR THE APP SHALL NOT EXCEED THE AMOUNT OF ANY PAYMENTS YOU HAVE MADE TO US, IF ANY, IN THE PAST SIX MONTHS.
The App and all intellectual property rights therein, including but not limited to copyrights, trademarks, trade secrets, and patents, are owned by us or our licensors. This Agreement does not grant you any rights to our intellectual property except as expressly set forth herein.
"Minj" and related logos are our trademarks. You may not use these trademarks without our prior written permission.
